ATHLETES HORIZON TERMS OF SERVICE Effective Date: July 17, 2026 These Terms of Service ("Terms") govern your use of Athletes Horizon. By creating an account or using the service, you agree to these Terms and acknowledge the Privacy Policy. 1. PURPOSE OF THE SERVICE Athletes Horizon helps community members donate sports equipment, request sports equipment, volunteer, participate in community activities, communicate about approved exchanges, and coordinate equipment handoffs. 2. ELIGIBILITY AND ACCOUNTS You must provide accurate information when creating and using an account. You are responsible for maintaining the security of your login credentials and for activity conducted through your account. You may not impersonate another person, create accounts for fraudulent purposes, or use another person's account without authorization. If you are a minor, you must use Athletes Horizon only with any consent or supervision required by applicable law. 3. DONATIONS When submitting a donation, you agree to describe the equipment accurately to the best of your knowledge. Do not offer stolen, counterfeit, illegal, dangerous, recalled, or intentionally misrepresented items. Submitting a donation does not guarantee that Athletes Horizon will approve, accept, match, transport, store, or distribute the equipment. 4. EQUIPMENT REQUESTS When submitting a request, you agree to provide accurate information about the equipment being requested. Submitting a request does not guarantee that equipment will be available or that a match will occur. Athletes Horizon may prioritize, review, approve, reject, or close requests according to availability, program needs, safety considerations, and community guidelines. 5. MATCHING AND DIRECT FULFILLMENT Athletes Horizon may recommend or approve matches between donations and requests. Administrators may also directly fulfill a request when appropriate without requiring a separate user donation record. Match recommendations are not guarantees. Participants are responsible for confirming that the equipment and handoff arrangements are appropriate before completing an exchange. 6. EQUIPMENT CONDITION Unless expressly stated otherwise, donated equipment may be used. Users should inspect equipment before use. Athletes Horizon does not guarantee that every item will be suitable for every person, activity, or level of play. Safety-critical sports equipment should be inspected by an appropriate qualified professional when necessary. Users are responsible for determining whether equipment is safe and suitable before using it. 7. EXCHANGES AND MEETUPS Use caution when meeting another participant. When possible, meet in a well-lit public location and consider bringing a trusted person. Do not pressure another participant to disclose unnecessary personal information or meet in an unsafe location. An exchange should be marked completed only after the equipment handoff has occurred. Where the app requires confirmation from both participants, both confirmations are required before the exchange is closed. 8. MESSAGING Messaging must be used for legitimate Athletes Horizon activities. You may not use messaging to harass, threaten, exploit, scam, spam, discriminate against, or abuse another person. Athletes Horizon may restrict access to messaging or accounts when necessary to protect users or enforce these Terms. 9. PROHIBITED CONDUCT You may not: • Commit or attempt fraud or deception. • Offer stolen, illegal, dangerous, or prohibited items. • Harass, threaten, stalk, exploit, or intimidate others. • Engage in hateful or discriminatory conduct. • Use the service for unauthorized commercial solicitation or spam. • Attempt to gain unauthorized access to accounts, systems, or data. • Interfere with the operation or security of the service. • Misuse personal information obtained through the service. • Violate applicable laws or regulations. 10. VOLUNTEERING AND COMMUNITY ACTIVITIES Volunteer opportunities and events may have additional requirements or safety instructions. Participation may be subject to approval, availability, age requirements, supervision requirements, or other conditions. 11. MODERATION AND ENFORCEMENT Athletes Horizon may review reports and take reasonable action to protect the community. Actions may include warnings, content removal, cancellation of a match, restrictions, suspension, or account termination. 12. NO GUARANTEE OF AVAILABILITY The service may occasionally be unavailable, interrupted, changed, or discontinued. We do not guarantee uninterrupted access or that every feature will always be available. 13. DISCLAIMER To the extent permitted by law, Athletes Horizon is provided on an "as is" and "as available" basis. We do not make guarantees regarding the availability, condition, fitness, safety, or suitability of donated equipment or the conduct of individual users. Nothing in these Terms excludes rights or protections that cannot legally be excluded. 14. LIMITATION OF LIABILITY To the extent permitted by applicable law, Athletes Horizon and its representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service or an exchange between users. Any limitations apply only to the extent permitted by law. 15. ACCOUNT SUSPENSION OR TERMINATION We may restrict, suspend, or terminate access when we reasonably believe an account violates these Terms or Community Guidelines, creates a safety or security risk, or is being used unlawfully. You may stop using Athletes Horizon at any time and may request account deletion. 16. CHANGES TO THESE TERMS We may update these Terms as Athletes Horizon evolves. Continued use after updated Terms become effective may constitute acceptance where permitted by law. Material changes may be communicated through the app or another appropriate method. 17. GOVERNING LAW These Terms are governed by applicable law. Any mandatory consumer rights available under applicable law remain unaffected. 18.
